Updates to Section 301, Section 232, FDA, and more.

New Section 232 tariffs on Certain Wood Products – Effective October 14

The U.S. government has announced new Section 232 tariffs on certain wood products, which will take effect on October 14, 2025, at 12:01 a.m. ET. These tariffs apply to goods entered for consumption or withdrawn from the warehouse on or after that time.

What’s Changing:

  • 10% tariff on imported softwood lumber

  • 25% tariff on certain upholstered furniture (increasing to 30% on Jan. 1)

  • 25% tariff on kitchen cabinets and vanities (increasing to 50% on Jan. 1)

Country-Specific Treatment:

  • UK: Tariffs capped at 10%

  • EU & Japan: Combined tariffs capped at 15%

  • Other countries may face reciprocal tariffs unless they are covered by trade agreements or exemptions.

 Additional Notes:

  • These tariffs are part of a national security measure under Section 232.

  • Some products may still be subject to antidumping or countervailing duties.

  • Countries negotiating with the U.S. may secure alternative terms.

CSMS # 66332530 - ACE Portal Updates to Enable Electronic Refund Enrollment Deploying September 30, 2025 (+ Support Call Details)

CBP rolled out enhancements to the ACE Portal on September 30, 2025, to support electronic refund enrollment via ACH, in accordance with Executive Order 14247.

Key Points:

  • Enrollment begins September 30, 2025 – Importers can now enter U.S. bank information in ACE to receive future refunds electronically.

  • Paper checks will continue for now. This is only the start of the enrollment period; CBP has not yet switched to electronic-only refunds.

  • Importers must have their own ACE Portal account and add bank details directly in ACE.

  • Coming soon: CBP will launch a new streamlined ACE account setup process (Form CBP-245) on October 31, 2025, for importers who don’t yet have an ACE account.

Section 301 Vessel Fees – Effective October 14, 2025

As outlined in CSMS # 66427144, starting October 14, 2025, new fees will apply to vessels entering U.S. ports that are:

  • Chinese-owned

  • Chinese-operated

  • Chinese-built

  • Foreign-built vehicle carriers

These fees are part of a Section 301 trade action in response to China’s efforts to dominate the maritime, logistics, and shipbuilding sectors.

Key Details:

  • Responsibility: Vessel operators, not CBP, must determine if the fee applies and ensure payment.

  • Timing: Fees must be paid before the vessel’s entry at the first U.S. port from outside the customs territory. CBP recommends payment at least three business days prior to arrival.

  • Non-Payment: Vessels without proof of payment may be denied lading/unlading or have clearance withheld until payment is verified.

  • Fee Schedule: Rates will increase at regular intervals over the next three years.

FDA Releases New Supplemental Guide v2.6

The U.S. Food and Drug Administration (FDA) Supplemental Guide (SG) draft version 2.6. Linked here: https://www.cbp.gov/document/guidance/fda-supplemental-guide .

In addition to the revisions, the following editorial changes are included in SG version 2.6 for clarification purposes:

  • Align import scenario for Intended Use Code (IUC) 100.000 and 210.000 (personal importation) for all commodities

  • Update PG01 notes in several commodities to clarify when IUC is mandatory, conditional or optional

  • In the tobacco section, PG02, indicates product code information for consumer use and electronic nicotine delivery systems (ENDS) products

  • Appendix B: update description for Food Facility Registration Exemption (FME) code B.

President Says Heavy Duty Truck Tariff Starts Nov. 1

The President in a post on Truth Social recently said all U.S. imports of medium and heavy-duty trucks will be subject to a 25% Section 232 tariff rate, staring Nov. 1.

This tariff follows the Administration's Sept. 29 proclamation imposing Section 232 tariffs for lumber, kitchen cabinets and vanities, and other wood products, effective 12:01 a.m. ET on Oct. 14. Nothing official has been released from Customs or the Federal Register. We will keep you updated as more information on this comes out.
